Please read these Terms carefully before creating an account or making a purchase.

By purchasing a course or package, creating an account where acceptance of these Terms is required, or otherwise agreeing to these Terms, you confirm that you have read and accepted them.

Nothing in these Terms affects any statutory rights that cannot legally be excluded or restricted.

"You" and "your" refer to the individual, school, organisation or other customer purchasing or using our products or services.

2. Who These Terms Apply To

These Terms apply to:

  • individual learners purchasing courses for themselves;
  • schools, colleges and other organisations purchasing courses or packages;
  • staff or other authorised learners given access through an organisation; and
  • users of our Website and online learning platform.

Some rights described in these Terms apply specifically to consumers.

Where a school, company or other organisation purchases our services for professional or business purposes, it will normally be treated as a business customer.

If you purchase on behalf of an organisation, you confirm that you have authority to enter into the agreement on behalf of that organisation.

3. Our Courses and Services

The Eduforesight Lab provides online professional development and educational training.

Our products may include:

  • assessments and reflective activities;

  • certificates of completion;

We may update course content from time to time to maintain its relevance, accuracy and quality.

4. Use of Artificial Intelligence-Assisted Tools

We may use artificial intelligence and other digital tools to assist with aspects of content development, editing, enhancement, design, research support, visual production or multimedia production.

AI-assisted tools are used to support our content-development process and do not replace our professional judgement or responsibility for the educational materials we publish.

Course content is subject to human review and oversight before publication. We take reasonable steps to check content for relevance, accuracy and educational suitability.

The Eduforesight Lab remains responsible for the final content that it publishes.

Where applicable law requires specific disclosure of AI-generated or synthetic media, we will take reasonable steps to provide the required disclosure.

5. Creating and Using an Account

You may be required to create an account to access our courses.

You must provide accurate and up-to-date information.

You are responsible for keeping your username and password secure.

Learner accounts are intended for use by the individual to whom the account has been allocated.

You must not:

  • share your login details with another person;
  • allow several people to use one learner account;
  • access another person's account without permission;
  • attempt to interfere with the security of the Website or learning platform; or
  • use an account fraudulently or unlawfully.

We may suspend an account where we reasonably believe that it is being misused or shared in breach of these Terms.

6. School and Organisational Purchases

Where a school or organisation purchases multiple learner places or seats, access is limited to the number of seats included in the purchased package.

The purchasing organisation is responsible for:

  • allocating seats only to authorised learners;
  • providing accurate learner information;
  • ensuring login details are not shared;
  • ensuring learners comply with these Terms; and
  • using the purchased package only for the organisation for which it was purchased.

One learner seat is intended for one individual learner unless we expressly agree otherwise.

School packages and learner seats must not be resold or sublicensed to another organisation without our written permission.

Where we permit learner substitutions or seat transfers, these will be subject to any conditions applicable to the package purchased.

7. Course Selection

The price payable is the price displayed on the Website or otherwise agreed with you at the time of purchase.

Prices may change from time to time. Changes will not normally affect purchases that have already been completed.

Any applicable taxes will be dealt with in accordance with applicable law.

Payment may be processed using third-party payment providers.

We do not normally receive or store your full payment-card details.

For school or organisational purchases made by invoice, any payment terms stated on the invoice, quotation or order confirmation will also apply.

9. Orders

Before completing an online order, you are responsible for checking:

  • the product or package selected;
  • the price;
  • the number of licences or seats where applicable; and
  • any stated access period.

Submitting an order constitutes an offer to purchase the relevant product.

A contract is formed when we accept your order and send you confirmation or provide access to the purchased product.

If payment has been taken but we are unable to accept your order, we will refund the relevant payment.

10. Course Access and Expiry

The access period for a course or package will be stated on the relevant product page, quotation, invoice, package description or order confirmation.

For individual online purchases, access may begin immediately following successful payment.

Where access is provided for a fixed period, it will normally expire automatically at the end of that period.

It is the learner's responsibility to complete the course within the applicable access period.

Failure to complete a course within the available access period does not automatically entitle the learner to an extension or refund.

We may provide an extension where we consider it appropriate or where required by law.

11. Consumer Cancellation Rights

This section applies where you purchase from us as an individual consumer and applicable consumer law gives you a right to cancel.

For many contracts made online, consumers may have a 14-day cancellation period.

Different rules may apply depending on whether a purchase consists of digital content, services or a combination of both.

Immediate Access to Digital Content

Our online courses are normally designed to be accessible shortly after purchase.

Where required by law, before digital content is supplied during the cancellation period, we will ask you to:

  1. expressly agree that supply of the digital content may begin immediately; and
  2. acknowledge that beginning supply may result in the loss of your statutory right to cancel.

Where those legal requirements have been satisfied and supply of the digital content begins, you may lose your statutory right to cancel.

12. Refunds

Nothing in this section affects your statutory rights.

Where digital course access has begun after the legally required consent and acknowledgement has been obtained, a change-of-mind refund may not be available.

Where no statutory cancellation right applies, including many purchases made by schools and organisations for business purposes, refunds will not normally be provided merely because:

  • a learner changes their mind;
  • a learner does not start or complete a course;
  • a learner does not use the full access period;
  • a school or organisation does not allocate all available learner seats; or
  • a learner's circumstances change.

However, we may provide a refund, credit, replacement course or extension at our discretion where appropriate.

If a course or service is faulty, materially misdescribed or not supplied as agreed, please contact us so that we can investigate and provide any remedy required by law.

13. Certificates and CPD

Where a course includes a certificate, learners must satisfy the relevant completion requirements before a certificate is issued.

Completion requirements may include completing required learning activities, assessments or other elements specified within the course.

Certificates confirm completion of the relevant learning activity.

Unless expressly stated otherwise, a certificate does not:

  • constitute a professional licence or formal academic qualification;
  • guarantee professional recognition;
  • guarantee employment or promotion;
  • guarantee improved learner or school outcomes; or
  • replace requirements imposed by an employer, regulator or professional body.

Where a course is described as CPD certified, accredited or recognised, that description relates to the certification arrangements applicable to that particular course at the relevant time.

14. Intellectual Property

Unless otherwise stated, the Website, courses and learning materials are owned by or licensed to The Eduforesight Lab Ltd.

This includes:

  • videos;
  • presentations;
  • written content;
  • graphics;
  • assessments;
  • templates;
  • frameworks;
  • downloadable resources;
  • audio;
  • interactive activities;
  • branding; and
  • other course materials.

Purchasing a course gives the authorised learner a limited, personal, non-exclusive and non-transferable right to access and use the material for learning purposes.

Purchasing a school or organisational licence permits access by the number of authorised learners included within the purchased package.

You must not, without our written permission:

  • copy or reproduce substantial parts of a course;
record course videos;
  • upload our materials to another learning platform;
  • publicly share downloadable resources;
  • sell or distribute our materials;
  • share login details;
  • remove copyright notices;
  • modify our materials for commercial redistribution; or
  • use our materials to create a substantially copied competing course or product.

15. Acceptable Use

You must not use our Website, courses or services:

  • unlawfully or fraudulently;
  • to transmit malware or other harmful technology;
  • to interfere with the security or operation of our platform;
  • to impersonate another person;
  • to harass or abuse another user or member of staff;
  • to upload material that infringes another person's rights; or

Serious or repeated breaches may result in access being suspended or terminated.

16. Platform Availability

Our courses are delivered online using technology and third-party learning-platform services.

You are responsible for having:

We aim to keep our learning platform available but cannot guarantee uninterrupted access at all times.

  • internet or hosting failures; or
  • events beyond our reasonable control.

If a significant problem caused by us materially prevents access to a purchased course, we will take reasonable steps to resolve the issue and provide an appropriate remedy where required.

Course content is provided for educational and professional-development purposes and should be considered alongside the learner's own professional judgement, organisational policies and any applicable statutory or regulatory requirements.

We do not guarantee that completing a course will result in any particular:

  • pupil outcome;
  • inspection outcome;
  • examination result;
  • employment opportunity;
  • promotion;
  • salary increase;
  • professional recognition; or
  • other specific result.

Schools and learners remain responsible for determining how course content is applied within their own professional context.

18. Third-Party Services and Links

We are not responsible for third-party websites or services that are outside our control.

Where you purchase wholly for business purposes on behalf of a school or organisation, and to the extent permitted by law, we will not be responsible for indirect or consequential business losses, loss of anticipated profits or loss of business opportunities.

Subject to liabilities that cannot legally be limited, our total liability to a business customer arising from a particular order will not exceed the total amount paid or payable to us for that order.

22. Suspension or Termination of Access

We may suspend or terminate access where there is a serious or repeated breach of these Terms, including:

  • unauthorised account sharing;
  • fraudulent activity;
  • non-payment;
  • serious misuse of our intellectual property;
  • abusive conduct; or
  • attempts to compromise the security of the platform.

Where reasonable, we will give the customer an opportunity to resolve the issue before terminating access.

We will not arbitrarily remove access to a product that has been paid for where the customer is complying with these Terms.

We will not materially reduce the overall nature or value of a product already purchased without reasonable justification.

If you are an individual consumer living outside England and Wales, nothing in these Terms removes any mandatory consumer rights that apply to you under the law of your country of residence.

For purchases made wholly for business purposes, the courts of England and Wales will have exclusive jurisdiction over disputes arising from these Terms or the relevant contract.
